These terms govern your use of the Foteza iOS app, Photo Lab, foteza.com, and related services (the “Services”). By downloading, signing in, or paying, you agree to them. If you do not agree, do not use the Services.

1. The product

Foteza is a cinematic camera and stills lab for iPhone. It lets you shoot Apple Log (on supported Pro models), apply LUT looks and lens treatments on the viewfinder, and run Photo Lab looks on photos you already have. Looks are inspired by cinema and film — they are not licensed replicas of any studio’s grade, and names are ours.


2. Accounts

You may need an Apple or Google sign-in to buy Pro, restore purchases, or use Photo Lab credits across devices. You are responsible for that account. You must be at least 16, or the age of digital consent in your country, whichever is higher.


3. License

We grant you a personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, as allowed by the App Store terms. You do not buy the LUT files, shaders, or Photo Lab recipes — you buy access. You may not reverse engineer, resell, or redistribute the looks, cubes, or models.


4. Your content

You keep the rights to video and photos you shoot or import. You grant Foteza a limited license to process that media only as needed to provide the feature you asked for (preview, save to Photos, Photo Lab generation, or a look-quality report you submit). Do not upload or generate anything illegal, or anyone’s image you do not have the right to process.


5. Photo Lab

Photo Lab sends the still you pick to our servers and an image model (currently Google Gemini) and returns a treated still. Scene lock: we instruct the model not to invent a new location, wardrobe, or person. Results vary. A generation that errors out is refunded. If the look is not what you hoped, you can report it — we refund those credits and use the stills to fix the recipe. Credits are not cash, have no value outside Foteza, and expire if we close your account for abuse.


6. Subscriptions, Pro, and credits

Prices, credit grants, and plan names are shown in the App Store and in the app at purchase. Payment is charged to your Apple ID. Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period in Apple ID settings. We do not issue refunds for unused time except where Apple or the law requires it — refund requests for IAP go through Apple.

Pro unlocks the full LUT library and related camera features described in the app. Photo Lab stills spend credits (currently 4 per still, with a small free trial). Subscriptions may include a recurring credit grant; extra credits can be bought as in-app packs. Unused credits do not convert to cash.


7. Acceptable use

Do not probe, scrape, or overload the finish server; do not attempt to extract LUT lattices or Photo Lab recipes; do not use Photo Lab to create CSAM, non-consensual intimate imagery, or other illegal content. We may suspend accounts that do.


8. Apple

You also agree to Apple’s Licensed Application End User License Agreement and App Store terms. Apple is not responsible for the app, support, or these terms. In-app purchases are Apple’s; their refund policy applies.


9. Disclaimers

The Services are provided “as is.” Log capture depends on your iPhone model. Looks, Photo Lab outputs, and exposure tools are creative, not color-critical lab measurements. We do not warrant uninterrupted service or that every generation will match the thumbnail.


10. Liability

To the fullest extent the law allows, Foteza Inc. is not liable for lost footage, lost profits, or indirect damages. Our total liability for a claim relating to the Services is limited to the amount you paid us through Apple for Foteza in the 12 months before the claim, or CAD $50 if you paid nothing. Some places do not allow these limits — in those places they apply only as far as permitted.


11. Termination

You can stop using the app and delete your account by emailing support. We can suspend access if you breach these terms or create legal risk. Paid time already granted by Apple is handled under Apple’s rules.


12. Law

These terms are governed by the laws of Manitoba, Canada, without regard to conflict-of-law rules. Courts in Manitoba have exclusive jurisdiction, except that you or we may seek injunctive relief in any forum for IP misuse, and EU/UK consumers keep any non-waivable local rights.

Before filing a claim, email support@foteza.com and wait 30 days so we can try to fix it.


13. Changes

We may update these terms. Material changes get at least 7 days’ notice on this page and, where we can, in the app. If you keep using the Services after that, you accept the new terms.
