1. Acceptance of Terms
By downloading, installing, or using the Foteza app ("App"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the App.
2. About Foteza
Foteza is an AI-powered video marketing platform designed to help business owners plan, create, and publish short-form video content to grow their business on social media.
3. Accounts
You must create an account to use Foteza. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account.
4. Subscriptions & Billing
Foteza Pro — $29.99/month Includes Fozi AI content planning, Auto-DM automation, lead capture forms, and multi-platform social posting.
Foteza Pro + Digital Twin — $59.99/month Includes everything in Foteza Pro plus AI Digital Twin video generation (up to 20 videos per month).
All subscriptions are billed monthly and auto-renew unless cancelled
A 3-day free trial is available for new subscribers
You will be charged at the end of the free trial period unless you cancel before it ends
Subscriptions are managed through Apple App Store. To cancel, go to Settings → Apple ID → Subscriptions on your iPhone
No refunds are issued for partial billing periods
5. Refund Policy
We stand behind our product. If Foteza does not deliver value for your business within the first 30 days, contact us at support@foteza.com and we will review your request. Refunds are issued at our discretion and processed through the Apple App Store.
6. AI-Generated Content
Foteza uses artificial intelligence to generate video scripts, content plans, and AI avatar videos. You retain full ownership of any content you create using Foteza. You are solely responsible for reviewing and ensuring that any AI-generated content is accurate, appropriate, and compliant with applicable laws before publishing.
7. Digital Twin & Voice Clone
By recording yourself for the Digital Twin feature, you grant Foteza a limited licence to process your likeness and voice solely for the purpose of generating AI videos within the App. This data is processed through HeyGen and ElevenLabs and is subject to their respective privacy policies. You may delete your Digital Twin at any time by contacting support@foteza.com.
8. User Content
You retain ownership of all content you upload to Foteza. By uploading content, you grant Foteza a non-exclusive, royalty-free licence to store and process that content solely for the purpose of providing the App's features to you.
9. Social Media Connections
Foteza connects to third-party social media platforms including Instagram, TikTok, Facebook, and LinkedIn. Your use of these platforms is subject to their respective terms of service. Foteza is not responsible for any changes to third-party platform APIs that affect App functionality.
10. Prohibited Use
You agree not to:
Use Foteza to create misleading, defamatory, or illegal content
Attempt to reverse engineer or copy any part of the App
Use Foteza to spam, harass, or deceive any person
Violate any applicable local, national, or international law
11. Intellectual Property
All trademarks, branding, and technology within Foteza are owned by Foteza Inc. Nothing in these Terms grants you any right to use Foteza's intellectual property.
12. Disclaimer of Warranties
Foteza is provided "as is" without warranties of any kind. We do not guarantee specific business results, lead volumes, or revenue outcomes from using the App.
13. Limitation of Liability
To the maximum extent permitted by law, Foteza Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.
14. Changes to Terms
We may update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the new Terms. We will notify users of material changes via email or in-app notification.
15. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
